GMV Innovating Solutions, S.L. (hereinafter GMV or the Proprietor) with tax identification number B85717775 and domiciled in Calle Isaac Newton, 11, 28760 Tres Cantos (Madrid), is the owner of the platform accessible through the URL: https://gmv.csod.com/ (hereinafter the Platform).

Next, the conditions that generally regulate the access to the Owner's page are shown, both the offered services and functionalities offered, without prejudice to the application of other different conditions or their modification. Regular reading and review is recommended as there may be changes in the legal texts.
General Terms of Use
- Identification of the Parties
These General Conditions of Use are signed by the Owner and you, as a User who is a natural or legal person, who voluntarily accesses the platform freely and without charge.
- Platform Objective
The purpose of this Platform is to manage and administer the selection processes of which the User is a part, as well as create an application history that can be administered by the User. Access and navigation on the Platform are free of charge.
- User Obligations
As a User by simply accessing and browsing through the Platform, you must:
- To use the Platform in a diligent, correct and legal manner, always respecting the legislation in force, morals and good customs, as well as public order.
- Periodically reviewing these General Terms and Conditions of Use, or any other conditions that may be applicable, checking any changes that may have occurred.
- Review communications sent, as they may contain important information.
- Not use the Platform for commercial purposes, especially to collect information or content for the purpose of providing services that clearly constitute a competence for GMV.
- Not modify or attempt to modify in any way, or perform actions or use means intended to simulate the appearance or functions of the Platform.
- Not damage, disable, overburden, or impair the service (or the network(s) connected to the service), or interfere with the use and enjoyment of the service.
- Refrain from performing any action that involves the introduction of computer viruses, worms, Trojans or any other type of malicious code intended to interrupt, destroy or limit the functionalities of the Platform.
- Not employ reverse engineering techniques and/or decipher, decompile or use any other system intended to know the source code.
- In any case, not perform any act that may infringe rights or interests of the Owner or third parties such as, for example, intellectual or industrial property rights (patents, trademarks, copyright, trade secrets ...).
- Availability of Platform
The Owner seeks to improve and expand the Platform, as well as its content and the services offered therein. Nevertheless, the Platform will be shown as it is at any given time, according to availability, limitations and other concurrent circumstances.
- Special Registration Conditions
These Special Registration Conditions are signed, on the one hand, by the Platform, and on the other, by the User who has completed the corresponding form to create an account and the steps indicated on the Platform to carry out the registration, together with the acceptance of these Special Conditions.
5.1. Requirements and Procedure to Create an Account
To create an account it is essential that the User is a natural person of legal age in accordance with Spanish legislation.
The User must provide name and surname(s), enter an e-mail address and other requested data, and back it up with a password. You must complete all the indicated steps, including reading the information regarding the Privacy Policy and these Conditions.
GMV will confirm the User's registration on the Platform by sending a welcome message, from which moment the User becomes a Registered User.
If the Registered User does not remember his/her password, he/her must click on "Forgot Password? Enter the e-mail through which you made the registration, to create the new password.
The Owner reserves the right to check and verify the identity of the User at any time. Failure to comply with the requirements of this section or misrepresentation of identity, entitles the Owner to terminate at any time such a User, exempting the Owner from any responsibility for such an action.
5.2. Platform
Registering on the Platform as a User allows you to access the status of the selection processes and manage user applications. As a Registered User you can also delete the data of your previous applications and manage your user profile.
5.3. Obligations of Registered User
The Registered User has the following obligations:
- Do not register with several User accounts on the Platform, or do so with false data or by impersonating third parties. You are responsible for providing your real data.
- Do not use or attempt to use another User's account without authorization or consent.
- Be solely responsible for all activities carried out from your personal account.
- Take care of the confidentiality of your access data, as you will be responsible for any damage suffered or incurred by third parties as a result of non-compliance with these Conditions. You are also responsible for what happens to your personal account unless the security of your account has been compromised through no fault of your own. Specifically, you should:
- Maintain an updated account.
- Store the chosen password confidentially.
iii. Be the only User who uses the account created.
- Do not market, sell or transfer the account to a third party.
- GMV reserves the right to verify the User's profile, and may delete or suspend the account in case of non-compliance with these or any other applicable legal texts.
- Exclusion of liability
GMV works to ensure that the services and functionalities of the platform are always available. However, when you access the platform, it will be shown to you according to the availability and limitations at the time.
Despite the continuous effort of the Owner to protect the systems and contents included in the Platform, for which purpose it uses the usual security standards on the Internet, it is not possible to offer full guarantees regarding any intrusions or loss of information that may occur. Similarly, it cannot be guaranteed that there are no viruses or other harmful elements on the Platform or on third party websites that may cause alterations to the User's computer system, both software and hardware. For this reason, the User assumes and understands that there are situations that may escape the control of GMV.
The Platform may include links to pages or sites of third parties outside the Owner, for which it assumes no responsibility by not approving or reviewing their functions and content. The User who accesses any link published on the Platform does so at his/her own risk and peril, without the Owner assuming any responsibility for it.
In the same way, the Platform is exempt from any responsibility derived from its misuse by the Users, as well as from the failure to comply with the obligations or commitments assumed by virtue of these conditions or any other applicable ones.
- Intellectual and Industrial Property Rights
All intellectual and industrial property rights over the Platform and its contents, including programming, design, applications, graphics, codes, text or images, trademarks, trade names, distinctive signs and other elements present therein belong exclusively to the Owner, including the GMV brand, or have sufficient rights and/or authorizations for their usage.
As a consequence of the above, any reproduction, distribution, public communication (including making available), transformation or any other form of usage, not even quoting sources, is prohibited, except with the prior, express and written consent of the Owner or the exclusive owner of the rights concerned.
Likewise, Users are informed that they must hold the rights to any content they upload to the Platform, and under no circumstances will GMV be responsible for such actions and content.

- Compensation
8.1. The Owner can penalize any of the Users that do not comply with the conditions applicable to them, with the impossibility of accessing, temporarily or indefinitely, the Platform. The duration of the penalty will depend on the type of offence committed. The restriction of access does not in any way imply a right to compensation.
8.2. Any type of damage, harm, loss or cost (including lawyers' and/or solicitors' fees) arising from a breach by the User of these Conditions or any other applicable ones, incurred by GMV must be compensated by the User who caused it. This covers any claims by third parties arising from such breaches.
- Modifications
These Conditions may be modified and/or updated at any time without prior notice. The modifications made will come into effect as soon as they are published on the Platform, whatever the means and form used.
The modification will only affect those Users who have accepted the modification beforehand.
- Other Matters
10.1. Safeguarding and Interpretation
If any of these provisions is declared by the competent authority to be illegal, invalid or unenforceable, it shall be interpreted in the manner closest to the original intent of such provision. In any case, such a declaration in respect of one or more clauses shall not prejudice the validity of the remaining clauses.
The failure of the Owner to require strict compliance with any of the terms of these Conditions does not constitute and may not be construed in any way as a waiver by the Owner to require such compliance in the future.
10.2. Language
The language applicable to these Conditions is Spanish. If versions in other languages such as English are provided, it will only be as a courtesy and for the convenience of the User. In case of contradiction, the Spanish version will prevail.
10.3. Legislation and Jurisdiction
The relations between the Owner and the User will be governed by Spanish legislation and any discrepancies or conflicts regarding these Conditions will depend on whether the User is a consumer and/or User in accordance with the applicable regulations.
As a consumer and/or user, disputes will be submitted to the Courts and Tribunals of the User's domicile. In case there is no such condition, disputes will be determined in the Courts of Madrid.
